2012 Election Update

The 2012 election essentially maintained a status quo in the two elected branches of the federal government. President Obama will return to a House of Representatives under the control of a slightly smaller, but comfortable, Republican majority and a Senate with a Democratic majority that has increased by two seats. For health care providers, this means that the implementation of the Patient Protection and Affordable Care will move forward. However, with the backlog of regulations still to be released, some provisions of the law may not be operational by the date specified in the law, such as the health insurance exchanges that are supposed to be up and running by 2014. Additionally, both sides of the political aisle are now looking at provisions of the law to see whether there are potential savings to be achieved that could be used in a grand budget compromise to avoid the fiscal cliff. It is believed that such a comprehensive budget compromise would address the Sustainable Growth Rate (SGR) formula and enact permanent Medicare physician payment reform.
